Our legal eagles advised us that there are potentially significant copyright issues involved in providing free ringtones / mobile content. In their considered view the original artist apparently owns some of the copyright of the ringtone, as it is based on their original work, whether it is
in ringtone or ringtone composer/keypress format in the same way as traditional music recordings and written music sheets.
So What does this mean to you ?
You may be personally liable for copyright infringement - If you download a ringtone (or key codes) if your provider does not pay royalties to the originator of the work.
Public domain works - Apparently ringtones containing excerpts of public domain works are an exception to the above. Public domain works are usually works which predate copyright laws or are in some other way defined as public domain works. For example classical pieces, are usually exempt as they
often predate copyright laws and copyright has not been established.
Music Industry Action ...
The music industry acting on behalf of copyright holders has already made initial moves to pursue what they see as their artists copyright.
We understand Sony Music has also issued legal notices against ringtones sites which are not paying copyright fees. In 2000, the EMI music group launched a major lawsuit against YourMobile.com which resulted in YourMobile having
to pay copyright fees. Though these are relatively early days, there is no doubt that as cell phones' capabilities increase, so will the lawsuits and legal battles.
